By participating and/or signing up to participate in the Silver Spur Ranch Horse Drive and related activities, you agree to the following terms and conditions. Please read carefully, as these govern your participation and limit liability.
1. Parties Covered
These terms and conditions cover Silver Spur Ranch, its owners, employees, affiliates, and any sponsors or participants involved in the activities at the ranch. By agreeing to these terms, you waive the right to hold any of these parties liable for personal injuries, damages, or death incurred during your participation in the Silver Spur Ranch Horse Drive.
2. Assumption of Risk
Participation in the Silver Spur Ranch Horse Drive involves inherent risks, including but not limited to serious injury or death. By taking part, you acknowledge and accept these risks. You agree that your participation is voluntary, and no amount of care or instruction can fully eliminate the dangers involved. You also agree to obey all posted rules and follow any instructions provided by ranch employees.
3. Liability Waiver
You release Silver Spur Ranch, its affiliates, employees, and sponsors from any claims of loss, damage, injury, or death that may occur during your participation in any activity. This includes claims arising from the negligence or inaction of the ranch or third parties.
4. Covenant Not to Sue
You agree not to file any lawsuits or take legal action against Silver Spur Ranch or its affiliates for any injuries, damages, or losses that may occur. This applies to injuries sustained by you or your family.
5. Indemnification
You agree to indemnify and hold harmless Silver Spur Ranch from any claims, damages, or legal costs arising from your participation in the Silver Spur Ranch Horse Drive, whether caused by your actions, negligence, or the actions of others.
6. Continuing Obligation
These therms remain in effect for all activities related to the Silver Spur Ranch Horse Drive, including future participation, and are binding on your heirs, estate, and assigns.
7. Insurance Requirement
You confirm that you have sufficient medical insurance coverage for any injuries or losses that may occur. Silver Spur Ranch does not provide liability or medical insurance for participants.
8. Medical Expenses
You are solely responsible for any medical expenses that may result from your participation, including emergency treatment or ongoing care.
9. Severability
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.
10. Media Release
By participating, you consent to the use of your image in photos, videos, or promotional materials related to Silver Spur Ranch events. No compensation will be provided for such use.
11. Physical Fitness
You affirm that you are physically fit and not under the influence of drugs, alcohol, or medication that could impair your participation. By agreeing to these terms, you acknowledge that you are voluntarily participating in the event, fully understanding the risks.
12. Cancellation and Deposit Policy
A non-refundable deposit of $2,000 is required to reserve your spot for the Silver Spur Ranch Horse Drive. The remaining balance is due 15 weeks before your scheduled arrival and is non-refundable. Silver Spur Ranch strongly recommends purchasing travel insurance, as no refunds will be issued under any circumstances after the due date. If you are unable to attend, we will assist you in transferring your reservation to another participant.
